Andrea Wilson Asks Court To Dismiss Kyrie Irving’s Suit Over Their Unborn Daughter, Azurie

Kyrie Irving’s baby mama-to-be has fired back at the NBA player’s alleged attempt to lowball her on child support.

Andrea Wilson asked a judge to toss Irving’s petition to keep their child support and custody case in Texas, where judges are thought to be less generous with child support amounts than judges in other states like California.

The former Miss Texas, who is set to give birth to a girl already named Azurie Elizabeth Irving in December, said in court docs that their daughter has yet to be born, so it’s too early to move on the case’s jurisdiction.

“The court cannot preside over a suit affecting the parent-child relationship when no child has been born,” Wilson’s lawyer said in docs filed Oct. 12 in Tarrant County Family Court.

Wilson’s filing came after lawyers for both sides tried – and failed – to settle the case out of court.

Wilson also asked that Irving’s request for a paternity test be dismissed because they both agree that Irving is the dad.

“With respect to the petition to adjudicate parentage,” Wilson’s court filing said, “respondent stipulates that petitioner is the father of the unborn child, and as such, there is no judiciable issue.”

Last month, the Cleveland Cavaliers player filed a petition asking the court to designate both Wilson and himself as “joint managing conservators,” of the baby, as well as a paternity test officially naming him as the father. Irving said Wilson should choose where the baby lived, but specifically requested that the baby be raised in Tarrant County, Tx. A source told BOSSIP that Irving’s pal Chris Brown – who is battling his own child support case in Texas – told him to keep the case there because he’ll pay less child support.

Wilson asked for Irving’s suit to be thrown out, that he pay her attorney’s fees. Her lawyer, Kelly McClure, declined comment Monday.
