Upon Steves death Mechelle became 75% owner of EVERYTHING Steve owned. She gets her 50% and 25% of his. The other 25% is owned by the children,parents, etc. When Mechelle dies she gets to will 100% of the estate, meaning her children will probably pick up her 75% plus the equal share of the 25% they received from their father.

More than likely Mechelle will only name her children in her will – so they will actually come out in the end for the better.

Tenants by the entirety is automatic in most states where a husband and wife buy property in both their names, in an instrument documented showing joint ownership that is transferred to them at the same time.

So if her name is on the deed with his and it shows joint/equal ownership. There is nothing more they need to do.

Actually intestacy laws allow for children to take from the estate as well. The surviving spouse does not get 100%

If they bought the house as Tenants by the entirety or joint tenants with the right of survivorship, then his outside kids have ZERO stake in the house.

As soon as he died, the house becomes hers.
