I WAS INVITED TO A PARTY AT THE 40/40 ON THANKSGIVING WEEKEND IN 2006 AND THE GENTLEMEN WHO THREW THE PARTY AND HIS FRIENDS GOT INTO IT WITH SOME OF THE SECURITY GUARDS FOR CHOKING UP ONE OF THE GUYS WHO WAS ATTENDING THE PARTY AS WELL. AT SOME POINT THEY DECIDED TO LEAVE AND ONLY MY BEST FRIEND AND I WERE LEFT IN THE “VIP LOUNGE.” ONCE IN THERE WE REALIZED EVERYONE HAD LEFT, THE SECURITY GUARDS THEN LOCKED US IN THERE AND REFUSED TO LET US LEAVE UNTIL WE PAID A TAB OF ROUGHLY $2700.00……..(NICCAS PLEASE) I HAD TO CALL THE NJPD ON MY CELL, ONCE THE OFFICER ARRIVED MY FRIEND WAS ARRESTED BECAUSE SHE REFUSED TO GIVE THE CLUB MANAGER HER NAME, THE POOR WAITER WAS CRYING SAYING HE DIDNT HAVE THE MONEY TO PAY FOR IT AND NEITHER DID I. ANYWAY, THIS STORY IS 100% TRUE, THE CLUB IS EXTRA TACKY, AND I VOWED NEVER TO RETURN TO ANOTHER 40/40 EVER IN LIFE.

This is standard at ALL bars, nightclubs and most restaurants. I waited tables through undergrad & graduate school. Bars and restaurants are only required to pay waitresses and bar tenders $2.15 an hour, so they live off of their tips. You also typically get no lunch break no matter how many hours you work. And YES you definitely pay for walk outs. But the theory behind that in bars is that you shouldn’t start a tab with someone unless you’ve taken a credit card from them. If you are stupid enough to run a tab for someone without getting a credit card from them…. yep you’re paying the tab if they disapppear on you. Depending on the spot you can make really good money. I put myself through grad school working 2 nights a week (WITH MY CLOTHES ON) at a trendy little night spot. Great way to make full time money working part time. Jay-Z may be shady with the dough….but not for this. I GUARANTEE every bar and nightclub in your city practices this.

I met a young lady who quit the 40/40 lounge. It was alot of BS going on in there. She just quit and got a better paying gig.

It’s not fair to make servers pay for trifling people. On the other hand, how will the business stay running if people continue to skip out on their bills and the money isn’t accounted for? Also, it’s not fair for the workers to only work for tips because some customers flat out don’t believe in tipping. In Florida, a server pays taxes on their tips. So even if someone tips them a quarter- they still have to claim 20% of tips at the end of the shift. They get $2.35 an hour plus tips. Hopefully, they will get tips. Still have to pay taxes on it though….

You’re absolutely right! Ive been bar-tending in NYC for over 4yrs and I was always paid salary and tips! It’s true that it’s common for spots to make u pay a tab if a group disappears but it was always MANDATORY that If u start a tab u must ALWAYS get a credit card w/ photo id or the person or party wont be allowed to run a tab. This included celebrity guest. I think the ALL the managers should be fired if they allowed servers to run tabs w/o receiving credit cards. I’m also NOT buying rumors that Jay had no clue. Him or his people knew and did nothing b/c like someone else said earlier he didnt care.

Its crazy cause I actually applied for a job at 40/40 when it first opened and was shut downed–I feel–b/c I wasn’t busty or light enough for the job. I guess GOD knew what he was doing.

I’m starting to really believe that. I was really bum that I didn’t get the job too but I later found a spot that was just as cool and I made $$$$!!

I also call BS on Jay-Z not knowing because he’s too busy.

When he’s not working he spends all his time in clubs and restaurants. He owns clubs and restaurants. He’s a control freak. He knows exactly what the practices are. Servers are supposed to take credit cards before running a tab. Servers are supposed to be on lookout for shady customers and alert their managers to the shady types. Managers are then supposed to keep an extra set of eyes on shady customers and security should be notified as well. If all of that fails then the restaurant takes the hit and maybe you look at new management. If the servers are comping friends left and right – then the server gets fired.

But at the end of the day you got a better job making more money not having to deal wit that BS. I use to worry and get upset when things would not go my way if I didn’t get a job i applied for, if I got laid off or fired from a job etc etc. I told my self I’m stop worrying and put everything in God’s hands and no matter what happens I keep pushing forward.

This is sad but unfortunately, this happens at a lot of restaurants/bars. I used to work for a payroll company and handled a lot of restaurant clients, and the employers will take all kinds of crazy “miscellaneous” deductions from their employees. Some would just report the employees’ wages as being paid at minimum wage and not record tips, so the employees would get mad when their W-2s came back incorrect. The employers don’t like to pay taxes on all of the wages, they want to report as little as they possibly can and charge costs to servers. Plus I’m sure this place had a high turnover rate, so it was easier for them to keep running their game.

If this is true, I’m glad the employees took a stance and got help. And JZ needs to hire whoever is managing the club, because it will just get worse, even if they find the accusations to be false. Cause if that manager stays, it will only get worse.

At most of the spots I’ve worked if a customer walks on you it’s your pocket. That’s why if someone’s running a tab you’re usually required to get an id and credit card no matter what. Now if its people dinning in then you just make sure u keep an eye on your table and or alert your manager if you think someone might be shady. You wanna have a group party u put down a deposit to hold the space. This situation is just another example of BAD management and apathy on the owners part.

Jay is BK all Day!!! But Damn Managae or controll the 40/40 properly and pay dem bartenders their wages. It is difficult being a Bar-ar-tender lol (T-Pain)

I agree. I used to know people working at a bar and they took money if you bailed on drinks. Tips were also kept in a pitcher and split at the end of the night. I used ot hostess at BBQ in the city and seen plenty of people walk away and the servers would be charged. That is why them girls threw their running legs on and tackled people in the middle of the street.

..i saw people at BBQ’s having trouble paying their bill..it was a table of about 20..about 6 were female and the dudes had no interest in giving extra money to pay the bill..but everyone had a GUCCi, COACH or Dooney & Burke bag, the dudes were ‘iced’ out..but they couldn’t pay for dinner..everyone in the restuarant was laughing at them because clearly they didnt have their priorites in order..what an embarassment

So your saying that it’s ok that your friend walked out on a tab of $2,700? You story sounds like a lie or you are leveling out some key details I personally know that to rent one of those rooms you must supply a credit card on arrival and that card will be swiped to insure that there is enough space for the minimum required for that room and the card is held until you close it out. And what kind of friend would leave you there like that?

With this being a class action suit the employes may see very little from this, but the lawyers will get paid.

If Jay Z keeps this up, he’s going to find himself out of business. He’s got a lot of money but that don’t mean a damn thing if you can’t run your establishment in a professional manner.

A waiter at another establishment was stabbed in the parking lot by a customer because of ridiculous business practices such as these. Jay z and management should be facing jail time for this.
