Diddy is facing a copyright infringement lawsuit over the design of his Sean John Unforgivable cologne, that could turn the successful fragrance into a pricy mistake. Pop the hood for details.
It doesn’t take a fine arts expert to see the similarities between Tom Patti’s 1981 sculpture “Compacted Gray With Clear and Ribs” and a bottle of Sean John Unforgivable cologne, but lawyers for Diddy are hoping they can get the lawsuit dismissed by blaming a Brooklyn based art magazine “The Urban Glass Quarterly” for planting the idea in the artist’s head.
Lawyers for Sean “Diddy” Combs filed papers in Brooklyn federal court last week asking a judge to compel The Urban Glass Quarterly to hand over all of the notes journalist Frida Hognabba took for her 2008 article.
“The article appears to have been conceived entirely by the Glass Quarterly parties, who approached [Patti] . . . with a suggestion that [Diddy's] fragrance package copied Tom Patti’s works,” Combs lawyers wrote in court papers.
We don’t blame Diddy or his lawyers for trying to get out of the suit. We’re pretty sure a judgment in Patti’s favor will be a pretty pricy one. Keep in mind that sculpture of his was valued at $40,000 in 2006 when it was displayed at the Heller Gallery in Chelsea.
Considering Diddy’s penchant for jacking samples for pretty much the entire Bad Boy catalog, from where we’re sitting there’s a pretty good chance he’s gonna have to pay up.
