City Offers Black Man $2.2 Milli After He Served 27 Years For Wrongful Rape Conviction

Man Exonerated After 22 Years In Jail

What would you do if you spent 27 years in jail for a rape you didn’t commit: If you had to fend off grown men, fight every day, eat crap around the clock or miss your own mother’s funeral? These are the questions running through the mind of Michael A. Greene, a man who was just exonerated and released after serving his entire adult life in prison.

Mr. Green, 45, was set free by a state judge two weeks ago after DNA tests on the rape victim’s clothing proved that he could not have been responsible for the crime. His exoneration was the work of a new unit in the Harris County district attorney’s office dedicated to reviewing claims of innocence.

Since he’s been released, he has had to decide whether to take a $2.2 million compensation payment from the State of Texas or file a civil lawsuit in the hope of exposing the truth about the investigation that led to his incarceration. To receive the compensation, he must waive the right to sue.

“What I really need to do is to make them pay for what they done to me,” he says. “Two-point-two million dollars is nothing when it comes to 27 years of my life, which I spent with mental torture and physical abuse.”

The story of Mr. Green’s nightmarish imprisonment — and how a prosecutor, Alicia O’Neill, eventually unearthed biological evidence that led to the real culprits — throws a harsh spotlight on an uncomfortable reality in American justice: the identification of a suspect in a lineup or in an array of photos is not always reliable.

He was walking home on April 18, 1983, the night a white woman was abducted and raped in his neighborhood by four black men in a stolen Camaro. He was one of several young men stopped by the police, but the victim could not identify him.

A week later, however, he was arrested after stealing a car and smashing it up. Detectives showed the victim Mr. Green’s mug shot, along with several other photos, and she said he might be one of her attackers. Later the same day, she picked him out of a lineup of five men.

He heard her scream from behind the mirrored glass when it was his turn to step forward in the lineup. He began cursing and yelling at the police.

“I got so mad, because I recognized it was a setup,” he said. “Then one of the police said: ‘I don’t know what you are mad about. I didn’t rape her. You did.’ ”

Mr. Green spit in the officer’s face, the first of many defiant acts.

A few days later, he turned down an offer from a prosecutor to plead guilty and serve five years for the rape, Mr. Green said. He recalls the trial as a surreal experience. It was the victim’s word against his. On the stand, she pointed him out again. He told the jury that he was innocent, but they did not believe him.

At 18 years old, he was sentenced to 75 years.

Over the years, Mr. Greene endured many attempts on his life, including one by a white supremacist gang leader seeking vengeance on behalf of the victim. Fortunately, his was one of many cases reviewed by the Innocence Project. They helped him get the DNA tests that ultimately led to his freedom.

They have since offered him a job as a paralegal with the Innocence Project of Texas. He says he plans to dedicate his time to “getting more innocent dudes out.”

    I don’t think we should assume that he would have made a million dollars a year for the past 27 years, unless he was working a position that paid him a million dollar salary before he was locked up. This is almost the exact samething that happened to a white guy down here in S. Fla. He spent 26 years in prison for a crime he didnt commit. Once he was released, they handed him a cool 2 million dollars and sent him on his way….sounds like they did for him what they would have done for anybody else.     $2.2 Million is nowhere near the amount of money they should be paying him for time spent. I would sue the state along with the woman if she was still alive. I’m sorry, but if you cannot truly identify the person who did you wrong or bodily harm…to me your testimony is no good. At that point it is your word against mine. I don’t see why a DNA test wasn’t done in the beginning anyway, but then again it is the state of Texas. He definitely should hold out. Those 27 years are worth more than the small change they are trying to bribe him with.

To be in a line-up, you have to have done something! If he had never been accused, he still woulda ended up in jail at some point in his life, w/o the $2 mill payout. Should the people who allowed this to happen be made to pay money, or should they be forced to spend 27 of their own years in jail? Somehow the punishment should fit a stolen life so people will be more careful in the future.     This is truly sad. It would probably be mind-boggling to find out just how many innocent people are locked up based off of one person’s identification. I mean, don’t white people think we all look alike anyway? There was a guy in Cleveland who was just released for the same thing–supposedly raping a white woman. He served 29 years before finding out he didn’t do it. Out justice system is racist and wack!

    I thank most of you for your positive comments regarding my uncle….but to the ones who don’t know sh** shut da fu** up….yea he use to still cars but gives them no right to sentence him that long and he was never charged with that. For all the ones who clearly don’t know my uncle he got his G.E.D while he was locked up and 5 different degrees…hell if he wanted to he could pass the state of Texas law exam..and he lost his mama who knew he was innocent all the way up till his death, his step dad,2 grandparents & a aunt 2.2 million dollars aint sh** when this man been innocent da whole time…and plus he aint no dumb man…already working as a paralegal its not the its the princeable of the fact

    it doesn’t matter whether or not he had a job before he went in….how would u feel if u couldn’t see the ones u love everyday? honestly, no amount could make up for 27 years. not even all the money in the world. i wonder if they even issued an apology. so many times u hear about someone wasting away in prison over something they never did, and the ones who placed them there don’t even apologize. the prosecutors say well i was just doing my job. no if u were doing your job this person would have never been in prison. their job is to uphold the law and not worry about whether their side wins or not. honestly i couldn’t live with myself if i placed someone in prison for circumstantial evidence. if the witness couldn’t identify him the first time and there was no speck of dna that could have placed him there then he shouldn’t have been convicted. if i was a victim, yes, i would want justice but i’d rather have the right man free than to have the wrong man incarcerated.

As for him, as unfortunate of a story this is, he better take the money and run. I’m not reading where the cops falsely accused him, the victim said it was him. They showed her pictures, probably of all the black men’s mug shots they had of that age, but SHE’s the one that went to court and adamantly said it was him. The cops shouldnt have shown her the pics then also had him in a lineup, but like I said, ultimately she said him. What is the real issue here is something i read about last year…Whites have difficulty positively ID’ing/describing blacks, especially males, to the police. This woman had FOUR attackers, so her recollection was bound to be faulty. And its not just Whites, b/c many Blacks have the same problem ID’ing unless there is some kind of significant quality. Overall, people have better luck ID’ing those of their own race.

    @ A Mess—it goes back to what I said in my post right above yours…Whites have trouble being able to ID Blacks; it’s not an assumption, it was shown in a study. And to think this woman had 4 black males to accuse, the odds are she was bound to get at least one identity wrong.

    Offering this guy $2.2 mil is a crime itself,
    Min for me would be a free house wherever he wanted to live under $1 mil, a holiday a year for life, free tuition fees then a lump sum of at least $10 mil.
