Bay Area Police Murder Black Man in Public

Damn, y’all, a black man’s life was worth less than the spent cartridge used to end it out in Cali as police put a cap in him while he was lying on the ground:
Law enforcement officials urged patience while they investigated details surrounding the fatal New Year’s Day shooting of a 22-year-old man by a transit agency police officer.
Bay Area Rapid Transit Police Chief Gary Gee said on Sunday that the agency is “committed to completing an unbiased, thorough and detailed investigation” of the shooting death of Oscar Grant.
“This case is not even four days cold. We’re in the early stages of the investigation and we will do a very thorough job,” he said.
Several unanswered questions remained after BART officers went to Oakland’s Fruitvale station to investigate reports of a supposed brawl on a train on which Grant was riding around 2 a.m. Thursday.
A friend of Grant’s who was with him on the crowded Oakland train station platform at the time of the shooting said Grant pleaded with officers not to harm him.
“Oscar yelled, ‘You shot me! I got a four-year-old daughter,”‘ said Fernando Anicete. “Oscar was telling us to calm down and we did. We weren’t looking for any trouble.”
Anicete was among more than 50 people attending a tearful news conference in Oakland on Sunday where Grant’s family announced they planned to file a $25 million claim against the Bay Area Rapid Transit agency this week. A claim is the first step in the process of suing the agency.
The family’s attorney John Burris said the shooting was intentional, and that he planned to ask Alameda County prosecutors to seek criminal charges against the officer. Burris said Grant, of Hayward, Calif., posed no threat to officers when a bullet entered his back and ricocheted to his lung area, killing him almost instantly.
You gotta be f*cking kidding that the police out in Cali are still executing blacks and other minorities with no regard. This is some bullsh*t and we’re glad the family is seeking retribution. R.I.P. young brother.

(01-05) 22:30 PST PST Oakland — Five days have p*****ed since a BART police officer shot and killed an unarmed rider on a station platform, but the officer has not given a statement to investigators about what happened and the transit agency has apparently not forced him to do so.
The delay comes as witnesses emerge with their accounts of what happened, some with video footage of the incident recorded on cellular phones. The hold-up is one reason why BART officials – even in the face of public outcry – have said little publicly about the shooting, including whether they believe it was justified.
BART has not released the officer’s name, but The Chronicle has learned that the officer is two-year BART police veteran Johannes Mehserle, who turned 27 on Monday and whose first child was born within a day or two of the shooting – an event that may be a contributing factor to why Mehserle has not yet explained the shooting to investigators.
Mehserle could not be reached for comment on Monday.
Officials have only said that Mehserle’s gun discharged, killing 22-year-old Oscar Grant of Hayward. He had been detained and forced to lie chest down on the ground at Oakland’s Fruitvale Station after 2 a.m. in the chaotic aftermath of a fight on BART on New Year’s Day. BART has promised a thorough probe, and Alameda County prosecutors are investigating as well, as is standard in officer-involved shootings.
But the delay is troubling to John Burris, the Oakland attorney who is representing Grant’s family and who plans to file a $25 million damage claim today against the transit agency, a legal precursor to a civil lawsuit. Burris is also calling for the officer to be charged criminally.
I’m not one for violence, I’m a mother but when the “authorities” have no regard or respect for our lives, we must defend oursleves by any means necessary. Just as they do. Stay awake in “09″ yall.

Before you lay blame on the victim, I hope you have watched the video, which is very disturbing and chilling. The young woman who took the video describes what she saw first-hand, and she clearly thinks that there was no wrongdoing or resistance to the officers displayed by the young man in question.

Regardless, another young black man dies. It certainly would be nice if our law enforcement put a higher premium on a young black life (no matter the history or clothes), but I think that we can’t expect outside forces to respect the lives of our young men until we show that we respect those lives ourself.

The raw cell-phone videos captured by witnesses on the train do not look promising for the BART police. The BART police do not have their own video – there’s a live camera feed that goes to the department from the Fruitvale station, but they haven’t had the money to upgrade their equipment so that it can record. This presents a crucial issue – what if there had been no witnesses with video recorders?
The atmosphere as shown in the videos is loud and contentious, but not violent – the young men who were removed from the train are sitting, not fighting, and the numerous police officers look calm. Oscar Grant, 22, is clearly shown on his knees, putting his hands up, and attempting to cooperate with officers.
Shortly afterward, two of the officers push him face down on the ground, with some effort, and then one of them fires the fatal shot. It’s difficult to see what is happening in the few seconds before the shot, but the police officer who fired it had better have an awfully good explanation about why an unarmed man with his face on the ground was an imminent threat.

This story happened on New Years Day. Here it is January 6th and this is my first time hearing about this. No Bossip is not the only site that I visit; I haven’t even seeb this story on CNN and I check CNN every hour that I am awake.

Did you see the editorial written by a brother who’s an editorial writer for the Times-Picayune that I posted today, by the way? I think you’ll find it very insightful, and, yes, he takes the suspect to task for his actions.
It was very powerful not only because of its focus on the horrific crime against a child, but he described his relationship with his own father, and the bonds between fathers and sons.

Moments before Oscar Grant was fatally shot by a transit agency police officer early New Year’s Day, he pleaded with cops not to harm him, a friend said Sunday.
“Oscar yelled, ‘You shot me! I got a four-year-old daughter,’” said Fernando Anicete, who was with Grant on the crowded Oakland train station platform at the time of his death.
“Oscar was telling us to calm down and we did,” Anicete said about 22-year-old Grant. “We weren’t looking for any trouble.”
Blood is in my eyes. This could happen to any one of us. If you watch the video it is very clear that not only is the officer NOT Black, but none of the boys posed a threat. What I find amazing is with all of the training officers get there appears to be no other alternative, but to use a gun to subdue or control a person. Got damn! One officer had knee on the dude’s neck and station is an enclosed *****e. Where the hell would this kid have gone if he ran? Yeah, I’m mad dude was acting the fool, but he didn’t deserve to be shot at close range in the back like that. Regardless, another young black man dies. Redd, did you watch the video? I know what I saw, and the young woman who witnessed the shooting and caught it on camera was also appalled by what she saw. There are other eyewitness accounts that all point to a blatant abuse of power and an unnecessary shooting.
I also found this tidbit from a poster on The Huffington Post, which I found interesting:

I’m really not sure what video you watched or where you read about this incident.
First of all-you cannot tell what the race is of the officer that killed the young man.’Light-skinned black man or some other ethnic minority’-really?You are making things up.
Additionally-in one of your many posts-you then stated that this guy was in a gang fight-where did you read that he was in a gang or a gang member?-and please don’t try to justify it by saying that ‘gang’ means a group of people. The report clearly says that the men were taken off the train for fighting-it doesn’t even say that he was involved in the fight-he could just have been part of the general group-we DON’T KNOW.
Even if these guys were fighting, from the FOOTAGE-they are ALL sitting on the ground and cooperating with the police-they were not resisting arrest-as you keep stating.
This guy had the ‘temerity’-it looks like to answer back or diagree with the police-but he was not fighting and looked to be pleading with the police before he was dragged off and restrained on the ground by several police officers. Then while RESTRAINED -he was shot, IN THE BACK.
The video horrified me-and I really don’tunderstand why you would jump to the aid of police-before asking yourself a few questions:how much of a threat is a person handcuffed and restarained on the ground-that he then needs to be shot-not even tasered-shot.
I live in the U.K-and I have seen instances MYSELF-where the police incite and aggravate a situation, especially if black people are involved-due to the fact that the police force HERE-like those in the U.S are institutionally racist, and populated with persons who won’t and cannot calm down a situation- which is part of their job and their duty-while trying to protect the public.

I had a friend who told me recently he was walking out of his apartment and saw the OPD (Oakland Police Dept) going through his mom’s car. They were caught off guard and he was caught off guard because on TV they tell you the police need permission aka a warrant. However, he was more upset because he realized THEIR surprise could have resulted in Diallo-like situation. Eventually the police explained his mom’s car “looked like” another white car that was used in a robbery. Even though my friend [hella skinny Nigerian who volunteers with at-risk youth] cooperated, they still hand-cuffed him with this as an explanation (and I quote): IF YOU RUN, I DON’T WANT TO HAVE TO SHOOT YOU IN THE BACK. Oh yeah, he told me all, but the Black officer laughed.

Exactly. Cops, like bankers, doctors, and garbagemen are human. As a black men, I have a good fear of them. And I use that fear to keep my ***** out of situations where I got a gun to my back. 2. In the news report video, they show a second video that shows clear as day there was no struggle and the kid is co-operating. Not only that, but one cop is holding him down while the other shoots him. THAT is an execution. You wanna send him a message by shooting him? Put a cap in his leg or arm but DO NOT shot him square in the back at point blank range. The cops were wrong and continue to be wrong by not making ANY statements.

Karina Vargas is the name of the young woman who captured the shooting on film and below is an excerpt of an interview she gave on what she witnessed:
Karina Vargas told CBS 5 that she was making the tape available so the public would know what transpired shortly after 2 a.m. Thursday at BART’s Fruitvale station when Oscar Grant was shot.
The video, that Vargas said she shot on a brand new camera she received for Christmas, would seem to support previous witnesses accounts that Grant was laying on his stomach with his hands behind him on the train platform when a single shot was fired by a BART officer.
According to Vargas, Grant was not resisting when the gunshot was fired. Vargas said she was standing only about 5 feet away from the shooting scene. She also said she resisted an officer’s attempt to confiscate her camera.
Vargas, who said she was on her way home from a New Year’s celebration along the Embarcadero in San Francisco when she witnessed the shooting, contended that Grant’s “rights were definitely violated” by police.

I have to agree everyone up in arms today about this young black brother being killed. Where was all this sympathy yesterday for the young boy who was killed by his trifling ***** father. From the video the man who fired his gun looked up at the other cop and back at Grant with the expression of “oh *****”. This is ridiculous.

WTH. I heard something about this but I haven’t seen anything about it on the news, so I forgot about it until seeing it again on this web site today.
The video was showing people on the ground and I ws hearing a lot hollering, the picture was going in and out of focus, then I head the shot but could not see when the shot was actually fired and at who. I wish it was more clear.
But you know what, IMO, the only thorough job the police are going to be doing is trying to find a way to come back and say the shooting was justifiable. This sh#t will never stop.

The BART officer was not Black and I am not sure where you got that from. This was pure criminal negligence on the BART officers part and he will be fired and should be charged with murder. Be careful about what you say…it might be your husband, son or brother, one day. This incident has hurt alot of people, those who knew Oscar and those who have never met him. His life was stolen and there will be a day of reckoning for it.

You don’t have to be armed to have a taser used on you. You just have to be fighting the officer. fighting with the officer can mean literally or not giving up your hands, trying to move around and get loose. BUT if you are motionless on your stomach and complying with their orders, there is no damn reason a taser should be pulled or used.
In this particular case the officers would have the right to use a taser if Oscar was being combative, but a gun should have never been pulled and there is nothing in policy that will be able to justify it.
this is such a outrage… and another video has surfaced this morning and is circulating the news today… that makes 3 videos… this video is more clear and clearly shows that the officer looks shocked at what he did as he looks up and down and at the officer next to him looks shocked as well… I pray for everyone involved…

Exactly. The only movement I saw in the video was among the officers, so why was the officer in question reaching for his “Taser?” How could he be combative when he was on his stomach on the ground?

As I watched the video, I had the eerie feeling that something bad was going to happen, no matter what those young men did. You could sense the fear, and I think there are few things more dangerous than a fearful officer.
I just thought of my brother, and I’m sure that as a black man, he has worked to make himself seem as “unintimidating” as possible when he is law-abiding, educated, and has never hurt a fly. But I know there are people who would eye him with caution and suspicion based on his skin tone.

One last thing….It really shouldn’t matter what the young man’s race was – or the other topics that have nothing to do with a young father being dead – just because you resist arrest doesn’t mean it’s ok to shoot the person, unless they are a threat to you or themselves. Basically, it was new year’s eve – and most people are out that time of night and most have been drinking, so people being rowdy is to be expected – we don’t know the full story – I just wish people would realize it’s more than color. It’s about all of us a nation knowing our rights and utilizing the law in the manner in which will help us rather than letting the law abuse it’s authority

And for you idiots out there who don’t have a brain… if the police says that Mr. Grant reached for his gun while they were struggling, that argument is completely mitigated once the officer who shot Mr. Grant stood up. He eliminated the threat by standing up.
Mr. Grant also could not have reached for the gun of the officer who had his knee placed behind his neck unless he was contortionist for Cirque Du Soliel. And since they’re touring in Atlanta right now, I would say those chances are also slim.

The police seen him as a threat…he had plenty of opportunity to sit his ***** down somewhere or take his ***** home, but he wanted to be apart of the chaos…that was his choice…and those were the consequences. I am not going to lie, if the story was about a Berkeley student, on the Dean’s list with a promising career/future, that was shot in the back cause he happen to be in the wrong place at the wrong time I would feel a sense of anger and wanting to get some quick justice or answers, but to me he was asking for trouble from the moment he decided to do whatever he was doing at 2am in the train station. Third, if you watch the vid from another angle closer up, as soon as the officer shoots the victims he looks up like “oh *****” in disbelief..

Ive taken numerous local, Metro, airport and state police/fire Department exams…Only two I have p*****ed. These departments do not want men and womene that think, they want individuals that act quick *****uming they will make an educated decision..I speak from experience..They dont want to know if you can read, write, or know what 2×2 is, they just want you to act quickly…It was funny, I was taking a the DC Metro exam and the instructor said that only 35% of people that take the exam P*****. So Im like oh *****, it must be hard…Well the test could care less if you could read or write, it was all situational questions….After the test I made the observation that most of the men that p*****ed that test (and I an not a prejudice person) looked like the average ***** hustling on my block…Now call that how you want to…
In no way am I asking people to lay down, nor justify the killing of a black male. I am telling you if you were not there for every minute, you cannot really grasp the psycological aspect of what happened….Dont let a video allow you to think irrationally…

The family has the best attorney in the bay area I can’t strss that enough he’s the best to take on these crooked cops I feel he’s the Johnnie Cochran for the bay area. To respond to your comment, I was simply stating that I would pretty much bet my salary that he was up to no good…would you put some money down that he wasn’t? Not just because he wasn’t attending Berkely…I was merely using that as an example which I will explain…when I firt read the story, It caught my attention…but after viewing the videos, if he was a person that wasn’t looking for trouble he would have conducted himself in a different manner. If it didnt concern him, he should have kept it moving, but obviously he had something to do with the situation due to him hanging around and continue to agitate the officers who were trying to get an already chaotic situation under control. Now had he been just p*****ing through…and the officer shot him in the back…or he had been sitting on a bench near the altercation and the officer approached him, harr*****ed him and tussled with him than that would have been a problem, but I just dont think that was the case. Him being a father, he should have taken that into consideration before letting his actions take over. I think about my kids first and foremost that is why all nonsense had to come to an end for me. I don’t allow myself to get drunk or to be in a situation to where it is dangerous to my life or my livelihood. That is called being responsible. All men need to be responsible for their actions, choices and so forth. Every action will bring about a reaction and every choice has a consequence. This young man, unfortunately had to have these consequences happen, everything happens for a reason. The officer will face his consequences as well. What those consequences will be, who knows, but God will decide that mans fate and everyone elses.
I can’t tell sh*t from that video but the outcome is certainly tragic. However, can someone please explain to me why when some ish is going down do black men tend to gravitate to it rather than turn and walk away (knowing damn well he probably has an outstanding warrant!)? I saw this a lot while growing up in South L.A.

considering the oakland police department has a history of trigger happy cops who love to abuse their power, this comes as no surprise. when african americans migrated from the south to the bay area, the opd recruited hundreds of cops from the south to keep a.a’s in line. “The Riders” were notorious for their shady dealings in the nineties. one of the cops ( i think his name was Jones) would bust a dope dealer in the afternoon, pocket the money, and be trying to holler at his woman that night at the club. true story. same bull*****, different day. this officer will probably be cleared, and he’ll go on abusing his position.

There’s no such thing as a “victim” Ppl always get exactly what they had coming to them. Spare the “blame” game from all situations in life and you’ll learn to take full responsibility ovver thoughts as well as your actions.
My thoughts on this matter:
There can be no justification for using force on an unarmed, handcuffed, sudued, and (by all accounts I’ve read) complying man. Its murder, pure and simple. Black communities (read: urban areas, inner city, etc.) are policed in a different manner than anywhere else…..including trailer parks where crime is just as rampant. We are not served nor protected…we are targeted. The Black community is already in a police state. Think otherwise and your eyes are shut and your mind is closed.
With that said, this is where I get off the bandwagon. I have always been more concerned with our inner turmoil than what the white man thinks of us or does to us. I don’t think we should accept being mistreated (I know, understatement) by the police……of course not. The thing is, if you are going to riot, protest or simply just get *****ed about this and incidents like it, but say nothing when countless number of Blacks are dying at the hands of their own, then you are missing the big picture. Do we need to stop senseless killings of Blacks by over aggressive policing. Sure. Is Black men mudering thier own a larger problem? Rhetorical question….you know the answer. I don’t expect THEM to value our lives……I DO expect us to. In Newark, NJ two young Brothas lost their lives since Jan. 1st…….no protests….no riots. Just grieving loved ones….watching the body count continue to rise. THAT is what *****es me off.

I think that both points are valid. I know that not all officers are bad or crooked even though that there are some that are. But please remember that these man and women that have taken the job of protecting the public are often times put into situations like this that many of us would probably do the same thing or panic or whatever. Crime is crime and is often times a matter of life or death and you can’t expect every single officer on the force to be able to use the perfect judgement for each situation. It’s not possible. From one of the videos, the officer’s reaction appears to be one of shock that he did shoot the kid. Like he didn’t intend to. But we don’t know what was going through this guy’s mind at the time. Police officers have protocols they have to follow and sometimes they either can’t or fail to do so. I’m not making excuses for police officers because I have to be real about the demands of what they do and the situations they are put in. Should he have shot this kid? From the video footage I’ve seen, no. I’m sure that there are protocols that all of those officers probably should have followed to put the situation to their advantage. Cause looking at the video, I wouldn’t turn my back to any of those boys on the ground without them being cuffed for fear of them trying to ***** my gun or them having something hidden that I may have missed on my pat down.
Now, I do think that black men have the power to diffuse alot of what many perceive as police bias against us. 1. don’t put yourself in a situation where the police have to get involved. 2. if you do encounter a situation like this, be as cooperative with them as possible and don’t give them any reason to pull a gun, taser or whatever. If they tell you to sit down, then sit down. If you have not done anything wrong, why fight back? Always in these situations, the police has the power. They also have the power of life or death because they are the one’s holding the weapon. Folks have to start being smart about ***** like this. You want to prove your manhood to a bunch of officers but trying to take them on and you don’t have a gun? Stupid. Me, I’ve been pulled over several times by both black and white officers and have experienced equal ***** from both. I also realize to that when I am pulled over or pulled up to not make any sudden moves, reach in my pockets, etc. because police officers pretty much trained to defend themselves first and ask questions later. I’ve have some “sum-*****” officers pull me up like they were looking for me to do something. All I did was cooperate, answer their questions and went about my business because you are in a situation where you don’t have any control or power but to cooperate and answer their questions. Puff your chest, get slammed. Reach in your coat or in this case resist, you could get shot. Yes there alot cops both black and white that have it in for brothas but there are also alot that don’t but you can’t put yourself in a situation where they have to decide whether it’s you or them because they will always choose them and leave your family with having to deal…

A couple days ago, a 22 year old black man who moved to TX after Hurricane Katrina came to visit his family out here in New Orleans,La. for the holidays was also gunned down by the police. He was shot twelve times in the back and four times in the front. His family said he never owned a gun, so they believe the police ended up planting guns on him to make it seem like they were defending themselves against this young man.He was a young black man, a family man, and a hardworker. What makes his story even sadder is that he has a newborn child. The police really abuse their power.

I have sons and I teach them about accountability, responsibility and all the other itys out there. Your right there is a definite prejudice out there and if we know about it, I am sure this young man was aware of it, before he decided to go out and enjoy his new Years, whether that was fighting at the station or running off at the mouth to cops/officers etc. I am hoping that my sons are smart enough to conduct themselves a lil better so as not to end up as a statistic period whether that is dying by the hands of a cop or dying by the hands of another black man etc.

They had atleast four cops there that could have restrained him no problem.

Unfortunately, it seems that his death was accidental. The cop that shot him looked genuinely suprised that his gun went off and not his taser. His actions appeared to be like, WTF just happened, like it wasn’t supposed to happen. Honestly, I can’t understand how one would confuse a taser and a gun. Though, I don’t think it was necessary taser him anyway. The cops should have handcuffed him and let him be. The cops were using excessive force, this shouldn’t have happen no matter he said to the cops’ faces. He was not handcuffed when he was shot, people. He was probably handcuffed after he got shot, which is stupid cuz he was literally flopping around like a fish out of water after he got shot. His handcuffs were gone when he was cartered out on the stretcher. His death definitely deserves involuntary manslaughter. We don’t really know what transpired before he was down on his against the wall. His family described him as a peacemaker. He could have been trying to break up the fight and was just dragged out with the rest of them. This is truly a grave and unfortunate loss of life. May he rest in peace and condolences to the family.

My name is Randy Santos I am a close friend of OSCAR GRANT. We grew up in the same neighborhood, two houses down, his family and mine were close as with everyone in our neighborhood. Knowing Oscar, and talking with other friends who were with him at the time I know for a fact that everyone was cooperating before watching him get shot OSCAR tells the officer’s to not shoot him, he has a daughter. As more video surfaces and witnesses speak up we all are knowing more of how unnecessary it was to murder my friend. Today I decided to stop following the news it finally hit me that I’m watching my friend get killed over and over again. I came onto this forum through the game’s website looking to send his camp an email to help expose this situation to the world.
This is a prime example of why I have a concealed weapons permit. I often carry a Gloc 40 openly on my waist and a Darringer tucked away in my snake skin boots!

Is this a hate crime or supposedly, only an accident due to the negligent discharge of a weapon? Does it matter? A young man’s life has expired while being apprehended under law enforcers. I can’t fathom any explanation that can justify this savagery act committed by the transit police. Even if this young man was unruly (I’m dubious), it’s very clear that this was conscious, authoritative abuse, resulting in ‘more’ odious, violent acts.
On another note, the number of deaths in our community has increased in intensity specifically in certain metropolises. What can ‘we’ do (awareness campaigns/programs) as a community (your locality) to reverse this epidemic/ endemic of self-bloodshed? We can dispute vehemently for several hours, but until we present antidotes, we are still affected directly/indirectly by crime, nothing changes, and more of our people p***** away.

If you were not a witness of the unnecessary shooting in the back of a man who was hand-cupped with a cop’s knee in the back of him with his face in the ground, the you really shouldn’t be speaking on it. The police had something to cover up that’s why they took one’s cell phone who got clear pictures of the wrongful shooting. The power-struck officer had no need to pull out his gun after he put it away and hand-cuffed the young man. From the looks, he thought that pulling out his gun would scare the young man into shutting up but whoops! he accidentally shot him. Who ever said the young man had to shut up after being thrown to the ground hand-cuffed. What happened to AMERICA’s FREEDOM OF SPEECH. The shooting was unjustified and they didn’t get everyone’s footage.

If the young man was detained… meaning he was in cuffs or zip ties then why was he shot??? If he was that unruly how did they get him detained anyway? This whole story is shady.

By no means do I agree with everything SMDH AKA Soy Sauce says, but regardless she is entitled to express her opinion just like anybody else. A large part of the problem (IMO)is that some people who frequent Bossip.com do not know how to disagree with someone else’s post without getting personal. If you talk about somebody’s mother or comment that their opinions are stupid, you are pretty much asking for retaliation. If someone routinely posts something that annoys you, stop reading their posts. Simple as that.

So, I finally watched the BART shootin video. Whether this shooting was intentional or accidental, the cop is negligent and can be — and should be — charged with a crime either way.
Also, the cop takes on a shooting stance by standing up and away from Grant. If he thought he had his Taser — which is one theory floating around — he would’ve stayed next to Grant to press the Taser onto his skin. This cop needs to be questioned by Oaktown police ASAP. This is straight B.S.
