The BART police officer that pulled the trigger and sparked another riot based on injustice has resigned:

Scheduled to meet with BART police investigators today, the BART Police officer involved in the tragic shooting New Year’s Day at Fruitvale Station submitted his resignation effective immediately. On Monday, the officer’s attorney postponed a meeting that had been scheduled by BART investigators for Tuesday and sought to defer the meeting until next week. BART investigators declined the delay and scheduled a meeting with the officer for this morning. At this morning’s scheduled meeting, the officer’s attorney and his union representative submitted his resignation letter. The officer was not present. BART investigators have urged the officer to meet and cooperate with the transit agency’s investigation into the fatal shooting. BART Police investigators have notified the Alameda County District Attorney’s Office of the resignation and this development. The District Attorney’s office is conducting an independent probe of the January 1, 2009 shooting. The BART Police investigation will continue to seek and examine all available evidence and will continue its full cooperation with the ongoing independent investigation by the District Attorney. “This shooting is a tragic event in every respect for all involved,” BART General Manager Dorothy Dugger said. “We recognize that the family and friends of Oscar Grant are in mourning and we extend our condolences.”

Oscar Grant did not have to die, but the pig that killed him should have to suffer some extreme consequences. This type of behavior must be extinguished. F*ck a Thug ass Cop too.

    Being a police officer is the only job that I know of where you can kill someone innocent and get suspended with pay (vacation)and have the option to resign or keep your job.

    There is also a case in Texas where an officer shot a young man in his drive way after accusing him of stealing a car that turned out to be his car..The dumb ass obviously didn’t bother to check registration..And guess what? He’s currently suspended with pay while this young man is in the hospital with a bullet lodged in his liver.

    Resigning doesn’t get him out of trouble. I’m sure his lawyer told him to hell with paid leave. He has to quit or he would be forced to give a statement to his employer. Now he doesn’t have to and he shouldn’t because it would only serve to incriminate him. I’m sure he will stay quiet until a plea deal can be worked out. There is no way he is getting off scott free on this one.

    From the video you can see the man on his stomach, with 2 cops on his back. The one that shot him stands up with his gun outstretched while the other cop is still on his back. Then ‘BOOM’ the standing cop shoots the guy and the other cop gets up and starts looking around like WTF? You can even see the other guy they were trying to arrest sitting on the side of all this (with his hands in the air the whole time) looking just as stunned like he might be next!

    Strange indeed how you can end up dead on your stomach with a bullet in your back all while cooperating.

    Deadly force is only to be used when there is an immediate, deadly threat. I have not watched the video yet myself but from the news and others, the man was lying on the ground handcuffed and posed no immediate deadly threat. Thus, there was no need for deadly force. And, by chance if he was acting up on the train there was no need for him to die for that unextreme behavior.

    That’s not good enough. They need to prosecute him “to the fullest extent of the law”… he committed murder. that’s it. that’s all. The sentencing will depend on whether his lawyer can back up the claim that he shot Oscar Grant by accident (it would’ve helped his case if he had at least released a statement or cooperated with investigation…).

    Seriously I would be interested to have ‘fire side’ chats about police brutality, crime in urban areas, about the government flooding certain areas with drugs, reverse stings.

    You ever wonder why everytime a Black man is shot by the police he has the same 38.special clinching to his lifeless body that every blackman in this country has in his hand when he is killed by the police? It’s like they mail that SET-UP gun around the world when they f**k up using their hair trigger fingers. I would like the panel to be non-politically or religious affilated (wo)men of all colors and from all walks of life. I would like to hear this panel speak with police departments in every major city. I’m not sure if that would happen.     They were passing the stop because there was a protest out there and people were blocking the entrances. They still went out to the next stop which wouldn’t be considered to be “safe” by white people. So while I understand your anger, they did that as a safety measure. Nothing to do with white people because a majority of the people that get off on that stop aren’t white.

    The victim in Texas (outside Belaire) wasn’t white, he was Robbie Tolan the son of retired baseball player Bobbie Tolan. Believe me this wouldn’t have happened to a white man there.

    As for that piece of trash in Oakland I hope they prosecute him as the murderer his is. My sympathy goes out to the Grant family.

    Yea, but the point is it just amazes me how a cop can kill or shoot someone and be treated like the victim..Even when they’re in the wrong they it’s never a situation where they get automacically fired or put in jail, they have to be second guessed and investigated to see if there’s anyway the person who got shot can be blamed.

If you saw the videos which it is very cleared this office committed MURDER, the man was laying on his stomach, what kind of danger to the police was he?     Only here in America can a killer be caught on tape murdering someone in cold blood, resign and keep benefits, hire a lawyer, put into protective custody, still haven’t been brought in for even questioning, hasn’t been processed, hasn’t seen a judge, doesn’t need to post bail, and just chilling until this situation boils over. The LEAST thing that should’ve been done was him being brought in with cuffs, finger printed, processed, stay in jail overnight waiting on the judge, bail should’ve been set to 500,000 dollars. If he posted bail while they are investigating then that makes more sense. How is he able to not even be brought in when you already have the identity of the suspect? Here it is 9 days later and this man is still chillin? They wonder why people are going made in Oakland? Possibly because they been writing letters to congress, been holding peaceful gatherings, been parading the streets for justice, been mourning. Still no answers…..9 days later. The news is barely showing coverage. This story gets 30 seconds and the riots get a full minute while Jett Travolta gets 5minutes of memorial pics.

    The reason he’s not talking is b/c he knows he’s going to face some form of murder or manslaughter charges. Resignation is his way of pleading the 5th. Speaking will only incriminate him further, so it’s up to the State to perform it’s own investigation to help develop the officers State of Mind during the time of the shooting.

    First Degree Murder would be hard to prove b/c I believe the State would not be able to prove the defendants requisite state of mind for Murder 1. The likely charge in the state of CA is 3rd Degree Murder. Look for the Defense to argue that they can’t get a fair trial in Alameda County and try to get the trial moved to a mostly white suburb. They will also try to play up PTSD since the now ex-cop did 2 or 3 tours in Iraq.

    This one is going to be a doozy folks, but if all else fails, he’s going to do at least 12-15 years for violating the civil rights of Mr. Grant. The Feds will get him.

    Recently, an older white man(that was supposedto be a CIA agent),was shot in Houston,at his car.

    There is also a gentleman that was shot 15 times in the back.(they said that he attacked them with a screwdriver). 15 TIMES IN THE BACK!

    THE REASONS THAT POLICE USE DEADLY FORCE

    It’s always been my question that ALL deadly force is excessive! (The police choose to use bullets,instead of RUBBER BULLETS, to subdue) They also SHOOT TO KILL,instead of shoot to subdue! My opinion would be to shoot a person in a NON-LIFE THREATENING MANNER,i.e.~ legs,then gas/pepper.

    We should attack the reason WHY we permit this type force! Too many black lives. Too many possible Obamas. (GET IT PEOPLE?) wE actually have the power to make this change happen!

    Yall gotta understand the police have procedures put in place for situations like this..I have never heard in Police wrongful death situations guilty or not the officer is tried immediatly..People need to let the investigation commence..People are drawing up conclusions of what has happend off two to three videos that dont provide clear account of what has happenend..

    I understand everyones anger, but seriously the anger should be against the Police Departments that train these officers..These officers are NOT trained to take the time to think..The entry level exams of being an officer is purely consist of situational questions! These police departments want men and women that act first and ask questions later..Thats why officer is not in jail…So technically the root of the problem lies in who administers these tests. THE STATE! They are mostly uniform all across the country.. Prince George County, Maryland officers kill or wound the most civilians in the country..yet Ive never heard of any officer being indicted on a life sentence and rarley involuntary manslaughter..The system is set up that way..The answer is not hanging the officer but protesting who trains these officers! THE STATE!

    there is a big difference between the polive force and the army. in the army,..the act first,ask later approach is necessary when you have bullets flying at you from every conceivable angle. even with the police,if you’re getting shot at, then shooting back is only logical. however, i see no reason why pulling out your firearm as a cop would even cross your mind when the suspect in question is face down and handcuffed behind his back.

    though the exams and training these officers go through may not adequately prepare them for real life situations (as red tony said),…common sense should prevail in such situations.the ability to assess the situation and thus decide on what level of force is necessary should come natural to someone who has played such scenarios in his mind a million time aka a cop. 1)Mr Grant was not a contortionist for Cirque du Soliel,or some super soldier…..2)a taser and a pistol are completely dissimilar.

    I have read every post set this morning and I’m a resident of the wonderful Oakland, CA. this crime, and YES it is a crime, of murder has hit us hard. And unlike most parts of the county you may not be able to see the coverage that we have. Just as if it had happen in your hometown, we may only be able to get bits and pieces. But I have included a link of our local station that has had every one involved in this case, trying to bring to this crime to a justifiable end. Please BOSSIP let this post stay so that the world can see what we here in Oakland are doing to start making our protractors (meaning cops) really protect us.

    What I find most appalling is the fact that the cop has not been charged with ANY crime. Prosecuters are way too crooked in the way they handle cases involving those in law enforcement that they lose all credibility. I am so sick and tired of the double standards in the [in]Justice System.

In such a fatal moment how do you forget left and right? If someone had been shooting at him would he have pulled out the taser? Beyond that let’s back track and ask was there even a need for a taser? Let’s back track some more and say was there even a need to slam him on the floor? On even the bluriest video you can see his hands up in surrender position. (Sarcasm) maybe he said, with his hands up, “I’m gonna shoot you officer” Sure… On top of that you had that heavy cop with his knee on his neck, his spinal cord for that matter. With that alone he could not have reach for any type of weapon with the disconnection of nerves. That’s common sense. I only watched 1 video and gained all of that on my own.

    I feel what you are saying and agree with most of what you are saying. We can look and talk from the outside of people that do not reports, but at the same you never know what’s really going on. I think it’s ignorant the whole “no snitching” thing, but theres also people who are genrally scared to tell police because many of them get brushed off or many get handed a complaint paper to fill out and the police never follow up on it. In fact when you do report such a killing or something where you fear for your life you are suppose to be placed in police protection. Read up on that whole family that was executed because the son witnessed a gang murder and reported it to police. They took out the man and his whole family who were in “police protection” at the time. Read about all the cases in Cali where people reported things and turn up in a garbage bag. You can find these instances in almost every state especially big cities where people are naturally scared because police rather shoot innocent people than protect the ones who are reporting crimes in their neighborhoods.

If you are handcuffed: you couldn’t sit down and follow instructions so you were FURTHER detained. The officer reaching for his taser / gun did so because he was looking to FURTHER detain this person who is STILL not seated as he was asked. Had he not been “aggitated” and had he just had a seat as the other two males OBVIOUSLY were doing..he could be alive today. No I do not think $25M is reasonable nor do I think it is warranted. I think that with all of the video posts of it and the fact that the actions of both the deceased and the officer speak on the situation that it was a turn of unfortunate events that has left one family mourning and another quite possibly fearing for their lives.

    Years ago- a man pulled over in his benz knocked to the ground, beaten, and cuffed over a “stolen” vehicle that couldn’t possibly be his. Plates were never ran until after they had him in a holding cell. They called it mistaken identity. He was a CEO of his own business.

    I understand what your saying about dialog. What I’m saying is why can’t this dialog be carried in a place where it fits. It has nothing to do with what the officer has done in this situation. That’s a seperate situation or situations that we need to address, but in this post is that the first thing ppl think of? Black on black crime? Why is that? It’s a trick that continues to plague the black community and it makes it easier and easier to kill more of us. When something happens instead of holding that person accountable we are so quick to judge what we were doing. He was unarmed and murdered point blank. I can care less of how those handcuffs got on his hands. Death is not warranted. I just gave a list of ppl that were either killed, shot, or beaten and did nothin. Black ppl did the same thing in those events. That’s why most of those cases are pretty much forgotten without justice.

    I love Haitians just like I love all people but Time for some real talk bruh… If Haitians have the ‘magical’ ability to turn people into cows then why the HECK are so many Haitians starving and eating mud cookies to survive???

    Why dont they turn the dirt into wheat and rice and corn. Or better yet, turn themselves into sharks so they can make it to Miami without drowning off the coast by the hundreds???

First, BART police will try to determine whether officers’ actions complied with the agency’s use-of-force policies, he said.

    That first review might be stymied: Mehserle has refused to be interviewed, and his attorney delivered a letter of resignation to BART police officials Wednesday.

    (01-08) 20:41 PST — The man who organized Wednesday’s BART police protest said he broke down in tears when he saw his peaceful march turn violent as some participants began throwing bottles, spitting on police cars and setting small fires.

    Evan Shamar said he left the demonstration and watched on television as the situation got worse.

    “I was devastated by it,” said Shamar, 24, a photographer who lives in Oakland. “I worked diligently for the past 72 hours, and for it to be destroyed by a group of anarchists was extremely upsetting. I felt like my integrity had been compromised.”

    Exactly! The problem in America pertaining to us is not poverty, unemployment, public housing, drug abuse, etc., per se. ‘Our’ major ‘problem’ is that we’ve been systematically locked into the lowest level of a game where incessant power was placed in the hands of white people to ‘force dissociation among us.’ We must re-distribute the power back into ‘our’ hands, but, we first have to ‘unite’ as one. For instance, think about how the Asian and Latino groups/cultures (China Town/Lil Havana) function so prosperously from their own markets/stores. I know that Asians and Latinos haven’t been dealt the same cards as we have, however it’s possible for us to flourish as a ‘group,’ and support one another.

    Yeah, it was. I think this is what you’re referring to. Here are some of them:

    In 1638, there was a public statement called Doctrine of Exclusion. It meant, in a nutshell, that Black people couldn’t enjoy the fruits of white society. In 1665, the Europeans passed over Enslavement Laws, and expanded the Doctrine of Exclusion. So, now Blacks were subordinated, non-compensated, and work-groups for the comfort and building of white society. In 1705, The Slave Codes were passed, this informed everybody of white preponderancy (black versus white). The Diversity Act of 1705, meant that for every six black people, a white person must exist within in the group so that we could be monitored, and we couldn’t be injurious to them.

    Well it is a good thing that he resigned. He had no business on the police force, if he couldn’t detain a subdued man lying face down without shooting him.

    Trigger happy cops should not be on the force. The man was not posing a threat to anyones life. He just pulled out the gun and shot him. I hope he serves prison time for this.

    This really troubles me, I would like to know HOW MANY WHITE MEN YOUNG WHITE MEN have been shot to death by police. I never hear this. Nobody should have to die like this regardless of color. But it seems to be black men only. They just killed the football player in Mississippi now this, What does a black Mother tell her child.

    my brother was beat to death in 2004 by some S.F,CA police and my son was beat in 2006 by some San Bruno, CA police, they need to get these dirty cops off the force period

    Going on 10 damn days now and the officer has not been arrested!!! The D.A. is finally involved and said it’s gonna take 2 more weeks to investigate and even then not everyone’s gonna like the results he said. What are they gonna do when the officer has fled and they can’t even arrest him? Then all hell will break loose on the streets again.

    Black on black crime is horrible and definitely needs to be addressed in our communities. However, police brutality is a separate issue and shouldn’t be put on the back burner until we fix our problems. Cops across this country continue to get away unscathed for killing our young black men – unarmed men. Sean Bell for example in NY shot on his wedding night over 40 times. If they would start to prosecute these officers and send a message that it will not be tolerated maybe it will stop. As it stands now these policemen no they can shoot a “nigga” and get a way with it. It is outrageous!!! Why do you never hear of an unarmed white man being shot in the back or being brutalized? This is 2009, we got a black Pres and this sh*t is still going on. It is really sad. Marching here in NY didn’t do us a damn bit of good. I have no idea of what else we can do but burn sh^t up.

    For those that still haven’t seen the video’s, there are several from different angles on KTVU’s website. They are the Bay Area station that have been giving the most coverage I think. This entire situation is horrific. I hope my people just think about peace and changing this the correct way instead of messing up our own community. I’m not surprised by the police departments actions, they’ve been doing it for decades. My prayers go out to the Grant family, Oscar’s girlfriend and 4 year old daughter.

    Carlos Miller, a onetime reporter and photographer for RAW STORY, posted a report on the new video on his blog:

    BART police officer Johannes Mehserle appears to be trying to handcuff him. A second cop appears to have his knee on Grant’s back while having some kind of conversation with another handcuffed suspect who is on his knees. The third cop has his hand on this suspect’s shoulder and looks like he is speaking into his radio.

    A female is standing inside the train filming the incident. You can hear her tell somebody, “baby, I’m fine, I’m just recording.”

    Then you hear a man’s voice from inside the train: “You gotta take pictures of that shit ….”

    Although Mehserle appears to be having some type of struggle with Grant, the cop with his knee on Grant’s back is blocking the view. The more I’ve watched this video, the more it seems as if Mehserle is trying to pull something out of his belt. Perhaps handcuffs. Perhaps a Taser. Perhaps a gun.
