Brian Banks To Sue State Of California

He deserves it and that bird who lied needs to be put behind bars for good:

A former high school football standout who was wrongfully jailed for rape wants California to pay for the time he spent behind bars. Brian Banks, 26, plans to file a claim against the state requesting money for his six years spent in prison, his attorney told the Los Angeles Times. According to his lawyers, Banks is entitled to $100 a day for every day he spent behind bars under state law.

Banks was exonerated this week after his accuser, Wanetta Gibson, admitted she had made up the whole story of sexual assault and had been reluctant to come forward because of a settlement she received from the school district. She also, according to the newspaper, had been worried it would affect her relationship with her two children now aged 4 and 5.

The one-time linebacker was 16 when Gibson, then a high school sophomore, accused him. At the time, he was a star middle linebacker at Long Beach Polytechnic High School and had verbally committed to a full scholarship to USC and a dream of playing in the NFL. But that was all crushed when he took a plea deal on the suggestion of his attorney who Banks said warned him the jury was likely to convict him.

A break in his case came when Gibson friended him on Facebook after he was released on parole saying she wanted to make “bygones be bygones”. Eventually her confession was recorded and with the help of the California Innocent Project, Banks was exonerated. “It’s been a struggle. But I’m unbroken, and I’m still here today,” he told reporters this week.

Lawyers for Banks told the Times he doesn’t plan on taking legal action against Gibson. “I know it’s best for me to try and move forward in a positive manner for the betterment of me, it hurts no one but myself to hang on to the type of negative energy,” Banks said Friday in an appearance on the “Today” show. Prosecutors told the Times they have no immediate plans to take on the now 24-year-old woman either. But according to a spokeswoman, police in Long Beach are “reviewing the matter”.

SMH. They certainly need to do “something” with that heffa.

Black Workers File Charges Over Racial Discrimination At Siemens Plant

This made our blood boil. We had to share it with you.

Welder Solomon Daniels had just grabbed his work clothes from his locker at the Siemens plant near Trenton when, he said, he saw the noose out of the corner of his eye, swinging from the shower curtain rod.

“I was more or less terrified,” said Daniels, 48, an African American man who lives in Burlington. Horrified by the noose, which evokes lynchings, Daniels looked twice to make sure, then called a coworker into the locker room to witness it. He took pictures.

That was Jan. 27. On Friday, Daniels and two other African American employees at Siemens Demag Delaval Turbomachinery Inc. talked to reporters about what they called a factory floor culture of racism and harassment in which African Americans couldn’t get promoted and complaints to the human resources department went nowhere.

Represented by lawyer Brian K. Wiley in North Wales, the men have filed complaints with the U.S. Equal Employment Opportunity Commission and the New Jersey Division of Civil Rights.

“When I first started there, the n-word was like your first name,” said Barry Murphy, 64, of Willingboro.

Employed at Siemens since 1966, Murphy, a machinist, wept Friday, saying he came forward so younger black workers wouldn’t have to experience the discrimination he faced. He said there hasn’t been an African American supervisor since the 1980s.

“The placement of a noose in a Siemens facility is a deplorable, aggressive act,” Siemens said in a statement, adding that it had hired outside investigators to look into the situation at its plant in Hamilton Township.

“Siemens condemns such behavior in the strongest terms,” the statement continued. Siemens said it retrained all personnel in company policies against harassment and discrimination and enclosed copies of the policies in employees’ paychecks.

However, the company said that, after reviewing surveillance video and interviewing employees, it could not determine who hung the noose. Daniels said he was asked whether he himself had hung it.

“I think that [question] is normal where the work environment is primarily white,” he said. “At the same time, it was hurtful.” He said he told officials he would be willing to take a polygraph test.

For machinist Eddie Clarke, 48, of Hatfield, the harassment went beyond the symbolic and annoying to physically threatening.

On Feb. 21, 2010, he said, he was coming around the corner, heading toward his tool cabinet, when a metal shank sliced through his pant legs and cut his leg. “I had to pull the metal from my leg,” Clarke wrote in a sworn affidavit. Someone had rigged a metal shank to his tool cabinet in an area where he was the only person working.

At the news conference, Clarke said that before the incident he had complained to top company officials about harassment. His supervisor warned him to stop complaining or he’d be the victim of “friendly fire,” Clarke said.

All three men, who are still employed, said they loved their jobs but feared for their safety at work.

“We have been in contact with federal, state and local authorities,” said Siemens spokeswoman Camille Johnston. She declined to say whether the supervisor had been disciplined. “The company is responding to the EEOC charges as appropriate.”

SMH. This is just unacceptable. They rigged the man’s area so he would be shanked??? And it’s not in this report, but another report says the supervisor who warned about “friendly fire” later told dude “I’m surprised you’re still alive.”

Shaquille O’Neal And Ex-Mistress Vanessa Lopez Headed To Court Over Harassment Suit

A trial date is set to be scheduled in a lawsuit that was filed against Shaquille O’Neal by his former mistress, Vanessa Lopez, RadarOnline.com is exclusively reporting.

Lopez filed the lawsuit against O’Neal in Orange County, Florida, for intentional infliction of emotional distress and assault. Lopez says Shaq started harassing her shortly after she told him she thought she was pregnant.

The former NBA center initially accused her of sleeping with someone else and when she broke off their relationship, she claims the threats began. Shaq tried to get the lawsuit dismissed, but was denied.

In the suit, Lopez claims she was the victim of a number of scary incidents — most notably a threatening text that Shaq allegedly sent to a friend of his saying, “dis is da numba shut dat b*tch up!”

Lopez says the friend responded with a text saying, “consider it done famo.”

The friend then jumped on a plane to Orlando, Florida, and allegedly texted Lopez before calling her on her cell, sounding “menacing and sinister.”

Sound like some crazy isht out of a Scream movie.

“A trial date is very close to being scheduled as settlement talks aren’t getting anywhere,” a source close to the situation tells RadarOnline.com. “The trial date will likely be set in the next 30 days and the trial could start later this year. Shaq would be forced to take the stand and answer blistering questions from Vanessa’s lawyers, Gloria Allred and Nathan Goldberg.

“Shaq wants to become the General Manager of the Orlando Magic and a public trial could very much harm his career and his legacy. Lopez’s lawyers feel that there is more than enough evidence to convince a jury of the allegations that she has made against him.”

Compounding matters, there’s a motion filed by Lopez’s attorneys to allow the trial to be televised.

“Vanessa wants the public to know exactly what Shaq did to her and she is looking forward to the day of taking the stand and telling a jury of her peers exactly what happened,” the insider says. “She wants him to be treated just like anyone else, it’s just about the truth, period.”

In the papers, Lopez claims that Shaq’s family was in on the intimidation act as well, making her fear for her safety.

Lopez, who’s seeking unspecified damages, claims Shaq’s 6-foot-6 and 6-foot-8 sisters made verbal and physical threats against her.

This won’t be the first time that we’ve heard rumors of Shaq gettin’ his Don Corleone on with these heauxs, he better hope he’s as innocent as he claims he is!

Man Sues Ex-Fiancee For Not Marrying Him

Usually people are just sad for a little bit, get over it, and move on with their lives. Not this guy!!!

She was sued for saying “I don’t.” A Manhattan executive is dragging his ex-fiancée to court after she failed to walk down the aisle. As CBS 2’s Sean Hennessey reported exclusively, he wants her to pay tens of thousands of dollars for those broken promises.

Steven Silverstein should be talking about his upcoming nuptials to Kendra Platt-Lee, set for September at a Long Island hotel. Instead, he’s fending off questions about his lawsuit against her. The suit claims Platt-Lee took the money and ran when she broke off the engagement last month. “I was blindsided, I will say that,” Silverstein said. The 29-year-old wouldn’t say much but his lawsuit speaks volumes, claiming the two opened a joint account at Chase bank “…to equally split the costs of all wedding expenses.”

From that account the couple paid rent for their Upper East Side apartment and deposits for the wedding venue, band, photographer and videographer, and the flowers. However, when Platt-Lee told her fiancé she wished to call off the planned wedding, she allegedly withdrew more than $54,000 the same day from their joint account “in excess of her entitlement.”

“I was with him on and off for about four years, so it’s little shocking,” Platt-Lee said. But on Wednesday night from San Diego, Calif., Platt-Lee said she gave back the engagement ring and doesn’t owe anyone anything. “I think a break-up is really emotional. We’ve broken up twice now, so I can just speculate that he’s hurt,” Platt-Lee said. Besides back rent, the suit also demands the withdrawal overage and more than $16,000 in wedding-related costs, totaling more than $61,000, plus interest.

“A lot of legal problems in this,” matrimonial attorney Raoul Felder said. Felder said there’s only one way to protect yourself when love is lost. “You take a pen and paper and you write down everything — who gets what in case it falls apart because many of these things do fall apart,” Felder said. Silverman’s lawyer told Hennessey on Wednesday night that case law and the state statute are on their side but a marriage attorney said while this is an interesting case it certainly won’t be clear cut because nothing is in writing.

Kim Kardashian Sues Australian Tabloid Over Drug Use Allegations

Kim Kardashian is telling friends she’s totally klean … and God help the tabloids that say she’s a pill popper.

Our Kardashian sources tell us Kim is furious over a report in an Australian mag claiming she takes Valium and sleeping pills in dangerous amounts, and the family is alarmed. Based on what we’re told, it appears Kim is not only Rx free, but she barely touches alcohol.

We’ve learned Kim has summoned her lawyers, who are about to fire off letters to the media outlets that report or pick up the Australian story … saying they’ll do so at their own peril.

BTW, the article also say Khloe has given her an ultimatum — either stop taking pills within 3 weeks or she’ll tell Kris Jenner and Kanye. Our Khloe sources say it’s totally false.

Kimmy is not about to let anything eff up her good drug-free name and alllllll the racks on racks it brings!

We always knew Sharon Stone was a c**t but there’s some real proof! The Hollyweird actress is facing a lawsuit from her former nanny which alleges Stone uses some really hateful language and doesn’t want to pay her employees fair wages:

Sharon Stone’s former nanny is going for bust with a damaging lawsuit accusing the “Casino” star of racial harassment, sweatshop conditions and wrongful termination.

In her nine-page complaint, Erlinda Elemen claims Stone repeatedly subjected her to painful “slurs” related to her Filipino ethnicity and heritage during her five years as a live-in housekeeper and nanny.

She claims Stone made derogatory comments about her Filipino accent and food and told her not to speak to the children because she didn’t want them to “talk like you.”

Stone “equated being Filipino with being stupid,” the lawsuit filed Wednesday in Los Angeles County Superior Court alleges.

Elemen claims Stone was “dismissive” of her deeply held religious beliefs, criticized her for attending church and once forbade her from reading the bible in the family’s house.

Her complaint contends Stone sometimes used her services seven days a week, on holidays and during trips out of town but that the actress balked after she learned Elemen was paid overtime for the extra work.

Stone allegedly accused Elemen of “stealing” the overtime pay in January 2011 and fired her a month later when the nanny refused to give the money back, the lawsuit filed by lawyer Solomon Gresen states.

Stone’s camp denied the allegations. “This is an absurd lawsuit that has been filed by a disgruntled ex-employee who is obviously looking to get money any way she can,” Stone spokesperson Paul Bloch said in a statement.

The “Basic Instinct” beauty has three sons that she adopted in 2000, 2005 and 2006.

TLC’s T-Boz Being Sued By Honda For Money She Owes On Her Mini-Van

According to TMZ reports:

T-Boz might be forced to travel in the passenger side of her best friend’s ride … ’cause Honda is gunning to repossess the rapper’s car.

TMZ has learned .. Tionne Watkins is being sued by Honda for failing to make payments on her 2005 Honda Odyssey.

In the lawsuit, filed in Georgia, Honda asks the judge for the green light to take the car back. It’s unclear how much T-Boz owes in back payments.

It’s just the latest in a string of financial woes for the 42-year-old rapper — she filed for bankruptcy back in 2011 … but failed to complete the required paperwork … and lost the protection bankruptcy provides.

In other words, there’s NOTHING stopping T-Boz’s creditors from coming after all of her possessions.

In all seriousness though, yeah T-Boz should have been more financially responsible, but we gotta put some of the blame on triflin’ azz Pebbles for “allegedly” stealing all that bread from TLC back in the day. Bet SHE’S not hurting for any money…SMH

John Travolta’s massage boo #2 may have some gwap on the way soon.

John Travolta’s legal team offered $125,000 last week to muzzle one of the masseurs who accused the actor of sexual battery, a source told the Daily News.

The “Pulp Fiction” star’s camp allegedly floated the six-figure sum to Atlanta-based massage therapist John Truesdale to withdraw his federal lawsuit. And, according to the source close to Truesdale, Team Travolta wanted the accuser to keep his trap shut.

“That is completely false,” said Travolta’s lawyer, Marty Singer.

The lawyer has repeatedly denied Truesdale’s allegations, calling them “ridiculous.” He said in a statement last week that Travolta’s accusers wouldn’t be getting a red cent.

“Not one penny has been paid nor do we have any intention to pay any money for these ridiculous and false claims,” Singer said in the statement.

Truesdale, a burly black belt and former U.S. Army medic, reportedly turned down the proposal. Soon after, he fired his original attorney Okorie Okorocha and hired famed celebrity lawyer Gloria Allred, the source said.

Truesdale withdrew the $2 million federal lawsuit against Travolta on Thursday. He also couldn’t be reached for comment on the reported settlement offer. The News was the first to identify the 250-pound masseur who filed the suit anonymously on May 8 — known then as John Doe No. 2.

The 40-year-old former high school football player claimed in court papers that Travolta groped him, grabbed him between his legs and pleasured himself in his presence during a private massage on Jan. 28. The 6-footer claimed Travolta accosted him in a 15th-floor suite at the Mandarin Oriental Hotel. At the time of the incident, the hotel was called the Mansion of Peachtree.

Truesdale’s claims against Travolta were linked to a similar lawsuit filed by a different masseur who claimed the actor touched him in the Beverly Hills Hotel on Jan. 16. That accuser — known as John Doe No. 1 — also withdrew his federal lawsuit last week and retained Allred.

Meanwhile, Truesdale’s name surfaced in a RadarOnline report on Tuesday. The celebrity website said he lost his job as a massage therapist in North Carolina about eight years ago. He was working at the plush Ballantyne Day Spa in Charlotte when he was axed for being “sexually inappropriate” with clients and co-workers, Radar reported.

An unnamed source told Radar that patrons claimed Truesdale removed the sheets placed over women during massages and touched their breasts.

Allred wasn’t buying it.

“The numerous attempts by supporters of Mr. Travolta to discredit John Doe No. 2 will ultimately be unsuccessful,” Allred said.

We’re pretty sure that if these guys dropped their lawsuits, Gloria already has some gwap on the way for them. The lady knows how to work.

Concert Promoter Plans To Sue Trina For No Show At Concert

According to TMZ reports:

Rapper Trina allegedly cost a concert promoter THOUSANDS of dollars this month … after no-showing at a performance in St. Louis … but Trina insists the promoter’s full of crap.

TMZ has obtained several letters sent to Trina’s booking agent — by the promoter’s lawyers — and according to the docs, the rapper was paid $7,000 to perform at a club called Imperial Palace in St. Louis on May 19th.

According to the letters, Trina’s team informed the promoter there was a scheduling conflict — but the rapper never formally canceled in writing, so the promoter went full steam ahead with the event.

Needless to say, May 19th rolled around — and Trina was nowhere to be seen.

The promoter tells TMZ, the event went on without Trina — held as a regular party at the club with DJ music — but people were pissed … and several demanded refunds.

Now, the promoter tells us, she’s planning to sue Trina for at least $16,000 — which includes Trina’s $7,000 fee, promotional costs, and other damages.

Trina’s rep tells TMZ, the rapper did agree to perform the gig — but cancelled long before the event due to other obligations … and even tried to return her $7,000 advance. Trina’s rep says the promoter refused to accept it.

What’s more, Trina’s rep believes the promoter falsely advertised the event as a Trina concert, knowing in advance Trina wouldn’t be performing. Trina’s rep says the rapper is now weighing legal options of her own.
