Grand Jury Expected To Reveal Decision In Eric Garner Case On Wednesday

The grand jury investigating the death of Eric Garner — choked to death by NYPD officers after selling cigarettes on the street — is expected to bring back their decision on Wednesday. With the disappointing outcomes of recent racially motivated police violence cases, people are hoping that murderous police will finally be asked to answer for their actions in a court of law. The Staten Island grand jury investigating the police chokehold death of Eric Garner has finished hearing testimony and will be asked Wednesday to decide whether criminal charges should be filed, The Post has learned.

The lawyer for the cop who put Garner into a chokehold said he didn’t expect the panel to deliberate more than two hours before making its decision.

“If there’s no true bill, I expect a press release. If there’s an indictment, I expect I’ll get a call to arrange my client’s surrender,” said Stuart London, the lawyer for Officer Daniel Pantaleo.

Prosecutors will sum up their evidence in the morning and give the grand jurors legal instructions, then tell them to start deliberating, law enforcement sources said.

It’s unclear what charge or charges the panel will be asked to consider.

During an unrelated news conference, Staten Island District Attorney Dan Donvovan urged the city “to be patient,” telling reporters: “We are going to let the grand jury do their work and then answer a lot of your questions.”

Donovan also said officials expect protests “regardless of what the decision is.”

NYPD Commissioner Bill Bratton said that while “people have a right to demonstrate,” cops will arrest anyone who commits an “actual crime,” including vandalism.

“We have the ability to have a level of tolerance, breathing room if you will, and we’ve been doing that for these last eight, nine days and this is a department that has a lot of experience dealing with various forms of demonstrations and we adjust our strategies and our tactics depending on circumstances of the moment,” Bratton said.
