Florida State Asks To Dismiss Lawsuit Filed Against Them By Jameis Winston Alleged Rape Victim
Jameis Winston may be done with college football but Florida State is still dealing the rape accusations he faced when he was their star player.
In documents filed this week, Florida State University wants no parts of a lawsuit being levied by the woman accusing Jameis Winston of rape … The university claims all the investigations into the alleged sexual assault proved their was NO evidence to collaborate her story … and they are demanding her lawsuit against them be thrown out!
You may remember that earlier this year, Erica Kinsman – the woman who accused football star Jamies Winston of raping her 2 years ago – waived her right to anonymity and took part in a documentary about rape allegations against college athletes. In January, not long before footage from that documentary began to circulate, Kinsman, using the name Jane Doe, filed a federal lawsuit against the Florida State University Board of Trustees accusing them of blowing off her claims she was raped by the Heisman Trophy star.
The woman explained she reported the rape to school officials but they did nothing to investigate her story. The suit claims the University ignored her because their priority was for Winston to continue playing for their team. She accused the University of refusing to take action against Winston despite her reporting the alleged rape. She also said they created a hostile educational environment due to the threats she received after her allegations became public.
Kinsman said the school didn’t even interview the football star until many months later and they never brought any consequences against him for his actions. She sued for emotional distress, loss of future earnings and demanded an unspecified amount in damages.
In a separate pending lawsuit Kinsman also sued Winston, who has always maintained the sex was consensual.
Just this week, on August 27th, FSU fired back at the woman’s lawsuit accusing them of blowing off her rape allegations to keep their football star playing on the team.
The school explains that 3 different investigations were done to look into the allegations Winston raped Kinsman – the Tallahassee Police Department, the State Attorney’s Office and retired Florida Supreme Court Justice Major Harding … and they all reached the same conclusion that the evidence did not prove that Kinsman was raped.
The school is demanding all claims against them be dismissed and Kinsman be awarded nothing. They say that any alleged damages she suffered were due to third parties they had no control over.
Further, they state they cannot be held liable for other parties actions since the alleged rape took place off campus. The school shoots down the woman’s claims they didn’t take action and also that they created a hostile environment for her at the University.
They also point out that the University had programs for sexual assault victims that Kinsman took advantage of following the alleged incident and they did everything in their power to investigate and respond quickly to her rape allegations.
Crazy story. Clearly some changes need to happen with the way athletes are groomed to deal with women because there have been an AWFUL lot of rape charges levied against athletes.
