Cleveland Cavaliers Star In Legal Battle After Traffic Stop Coming From “Home Girl’s House”
NBA star Iman Shumpert is headed to trial in a case where cops said they found him stoned behind the wheel.
The Cleveland Cavaliers star, who recently married his long-term partner Teyana Taylor, will head to trial in his DUI case in Fayette County, Ga. next month, BOSSIP has learned.
The trial comes despite Shumpert asking the judge to throw the case out because he claimed he was arrested under dubious circumstances and was coerced into taking a blood test.
Cops arrested Taylor’s other half in August 2016 on the outskirts of Atlanta for allegedly failing to stay in his lane of traffic. The officer said he smelled weed, and the baller infamously declared that he was coming from his “home girl’s” house. Cops said they later found Shumpert with a mason jar full of pot. He was charged with DUI, possession of less than an ounce of marijuana and failure to maintain a traffic lane.
Shumpert’s lawyer said in court papers that the baller was headed to the Atlanta airport to pick up his father, and his driving didn’t violate state law. Therefore there was no good reason why the cops pulled him over, and the lawyer called the stop “illegal.”
Here’s NBA star Iman Shumpert after being arrested on suspicion of driving under the influence of marijuana in Fayette County, Georgia, on August 10. The 26-year-old Cleveland Cavaliers player was pulled over by cops for a lane violation and for having his tail lights out. He allegedly smelled of weed, and had bloodshot eyes, according to reports. A field sobriety test determined the athlete was impaired and cops say he admitted to smoking cannabis at a friend’s house that evening. Officers also found a small amount of the drug in the car, which was reportedly a rented Audi A3. Shumpert, who is engaged to Teyana Taylor, is charged with DUI marijuana and possession of weed (less than an ounce), as well as being cited for failure to maintain lane.Picture by: Splash News
Shumpert said in court papers that the cops had no right to search him after pulling him over, and violated his constitutional rights against warrantless arrest, self-incrimination, due process and equal protection under the law, and asked for the judge to dismiss the case.
Shumpert’s lawyer argued that the tests were poorly administered and weren’t performed within the state’s law enforcement guidelines, and the cops never bothered to read him his Miranda rights. Shumpert’s defense also wants anything the father of one said once in custody to be thrown out, as well as the baller’s “heel to toe” and “one leg stand” tests that cops had him take.
However, the judge wasn’t having it, and Shumpert will have to be in court for trial June 26.
If convicted, he faces up to a year in prison, an $1,000 fine, community service and license suspension.
