Driving drunk even gets one-time in trouble:

An off-duty cop and two passengers were injured in a drunken driving accident early Saturday when their car flipped over and slammed into Tiffany’s famed midtown storefront, police said. Officer Raphael Ospina was behind the wheel when his luxury car plowed into a garbage truck at the corner of 57th St. and Fifth Ave. before careening onto the sidewalk at 3 a.m., cops said.

Blood was splattered throughout the inside of the crumpled Chrysler 300, but while all three men were rushed to Bellevue Hospital, their injuries were not considered life-threatening, officials said.

A champagne cork and a carton of Tropicana orange juice were spotted inside Ospina’s car, which had its windshield shattered in the crash. Its roof was cut off by firefighters to rescue the men trapped inside. Ospina, 27, was charged with driving while intoxicated and vehicular assault.

His brother defended the cop – but when asked if the officer had driven drunk before, he answered, “I’m sure he has.” “He’s the type of guy everybody likes to be around – he puts people in a good mood,” said Daniel Ospina, 19, at the family’s Fresh Meadows, Queens, home.

“I have to stick up for him, he’s my brother,” said the younger Ospina. “Everyone makes mistakes. Nobody’s perfect.”

“He’s an awesome guy,” the brother said. “He’s not a bad cop.” Investigators believe the garbage truck from Five Star Carting Inc. was traveling west on 57th St. and turned south onto Fifth Ave. when it collided with the Chrysler. The spinning sedan was propelled onto the sidewalk where it knocked over a tree and garbage can before slamming into Tiffany’s, damaging the front facade of the iconic jewelry store. One of Ospina’s passengers suffered a broken arm, while the cop broke three ribs and suffered a head laceration, officials said. The other passenger was treated and released.

The driver of the garbage truck, identified by his co-workers as Juan Santiago, was not hurt. Santiago, who remained at the scene of the crash and cooperated with investigators, was shaken by the wreck, one colleague said.
