Arizona’s Immigration Law May Be Challenged By Justice Department Lawsuit As Early As Today

The Justice Department could file a lawsuit challenging Arizona’s immigration law as early as Tuesday, an official tells Fox News.

The potential court action comes just days after President Obama delivered a speech calling on Congress to tackle a comprehensive overhaul of the nation’s immigration system. In the speech, he criticized Arizona’s law and warned that national legislation is needed to prevent other states from following suit.

The president did not mention the lawsuit, but one was widely expected. After the administration initially said it would take the law under review, Secretary of State Hillary Clinton revealed last month in an interview with a foreign television network that the administration intended to challenge the Arizona policy. The Justice Department would do so on the grounds that federal responsibility for border enforcement preempts any state law on the issue.

The Arizona law, passed in April and set to go into effect at the end of July, makes illegal immigration a state crime and requires local law enforcement to question anyone they suspect of being an illegal immigrant on their residency status.

Obama and other top officials have criticized the law as misguided, while Arizona Gov. Jan Brewer has slammed the administration for pursuing a lawsuit. She claims the administration has not done enough to secure the border — a charge the administration denies.

The Arizona law has touched off an intense national debate over immigration. The results of any court challenge would have wide-ranging implications, as a number of other states and jurisdictions have taken up tough immigration policies similar to Arizona’s.

The Obama administration has meanwhile tried to use the law as the impetus to prod Congress into tackling an immigration bill. While Arizona lawmakers defend their law as necessary to patrol the border, Obama described it last week as “unenforceable” and a vehicle for civil rights abuse. He said a “national standard” is needed and that he won’t “kick the can down the road” any longer.

Republicans bristled at the speech, though, and continued to urge the administration to better secure the border before tackling a comprehensive bill — which would likely include a pathway to legal status for millions of illegal immigrants

The immigration issue has divided the country in recent months. Does Arizona have a right to try and secure their own border without federal government interference? Or is the Justice Department just doing its part to protect people’s civil rights?

    Ok I guess I wasn’t first. Anyway, the only solution to our immigration problem is to literally militarize the border – with tanks, guns, whateva. We all know that making people carry “papers” and pulling them over for “suspicious reasons” is racial profiling. Have we not studied World History? Do we not remember how this sounds like the beginnings of the Holocaust? Of course not, people in Arizona don’t study history like that. DISGUSTING. And ditto what someone said about this lady’s wrinkled cleavage. YUCK!

    Finally! I am against illegal immigration. But I think the Arizona Bill is a slippery slope.

    The people/group who formed this bill also wrote also paper about having to stop the influx of non-whites in the country because white people arent as fertile as blacks and other minorities and would be outnumbered.

    This is what the bill is REALLY about.
    I wish people will read and understand what is really being said.

    Thank you. As you can see, I was being conservative when I said thousands. What kills me is that Illegal Mexicans play this game that their rights are being violated. I still can’t find a clause that says illegals have rights to live in the U.S. Illegal Mexicans play head games like, we need reform. In my opinion..the only reform we need is to streamline the process but keep all criminals out and if you are not a political refugee or not dying from hunger……stay out. And what perturbs me the most is that illegal Mexicans are always waving their flag here. I don’t understand. Why not wave it in your country of origin which is right across the street????

    Don’t get me wrong, I ain’t no fan of illegals, but I’m intelligent enough not to deal with this because of how I FEEL, but want to deal with the logistics . . .

    I mean, how do we fix it? How you gonna stop people from coming over the border? Well, when you stop making it worth their while, they will stop coming.

    Also, get at the Mexican government to make them do something for their own people. They come here, make all the $$ and send it back to Mexico.

    I would rather see my tax dollars go trying to correct what desperately needs to be corrected as far as illegal alien issues than to just keep handing it over to them tax free week after week, month after month, year after year as we have been doing for way to long. Seems we keep paying and paying and paying and soon we won’t have anything left for our families or ourselves. It is unconscionable that those born here, and have always worked and paid taxes, are less worthy of the benefits afforded to those that sneak into this country.
